1. General Provisions

  1. Fresh Market 2023 B2B Meeting and Trade Show, hereinafter referred to as the Event takes place on September 20, 2023 at the Mazurkas Hotel facility in Ozarow Mazowiecki. Organizer’s Office: ul. Marii 17/25 , 05-803 Pruszków, tel. +48 603811818, www.freshmarket.eu
  2. The Organizer is KJOW Sp. z o.o. ul. Marii 17/25 , 05-803 Pruszków, NIP PL1181976336, KRS 0000321131 represented by www.fresh-market.pl.
  3. The Organizer undertakes to prepare the Event, which consists of: meetings with buyers from retail chains, distributors, exhibition of stands, announcement of Fresh Market Award results. The Event lasts from 9:00 am to 7:00 pm.
  4. The Organizer undertakes to publish on the freshmarket.eu website up-to-date information regarding the program of the Event. The Organizer reserves the right to make changes to the program.
  5. The Organizer provides Participants with the opportunity to meet buyers of up to 5 (five) retail chains. The Organizer does not guarantee permanent presence of buyers of the retail chains at the stands, from the beginning of the Event until its end. The Organizer does not decide on the sequence of meetings, their length and does not take responsibility for the results of negotiations with buyers of the retail chains.
  6. The Organizer provides the Participants with refreshments during the Event: breakfast, lunch, all-day coffee break and cocktail dinner party.
  7. Definitions of terms used in these Regulations:
    1. Organizer: the company KJOW Sp. z o.o. , ul. Marii 17/25 , 05-803 Pruszków, NIP 1181976336, KRS 0000321131 represented by www.fresh-market.pl,
    2. Registrant: natural or legal person making the registration of the Participant or Participants,
    3. Participant: person registered as part of a package of participation by the Registrant,
    4. Advertiser: a Registrant who has purchased advertising services as referred to these Regulations.
  8. Statement of participation in the Fresh Market 2023 implies acceptance of these Regulations.
  9. These Regulations shall come in effect as of 01.06.2023r.

2. Enrollment

  1. In order to participate in the Event, applicants are required to fill out on-line registration forms available at https://freshmarket.eu/pl/fresh-market-b2b-meetings-trade-show-2023/rejestracja-fresh-market-2023/
  2. Applications shall be submitted not later than 15 September 2023.
  3. The Registrant undertakes to complete the on-line registration form correctly and consistently with the facts. Presented data shall be consistent with the actual company/Participant status.
  4. The Organiser is not responsible for damages resulting from the introduction to the registration form of incorrect data by the Registrant.
  5. The Organiser undertakes to conceal all information (data) received from the Registrant, excluding information designated to be entered in the printed and online materials of the Event.
  6. Filling out the registration form is tantamount to entering into an agreement with the organizer in accordance with these Regulations. It also implies acceptance of the provisions of these Regulations and compliance with the regulatory requirements, as well as any other arrangements made between the Participant and the Organizer. It also entails an obligation to make payment for the ordered participation package

  8. The price includes: meetings with buyers from max. 5 (five) retail chains, unlimited meetings with distributors, networking & matchmaking, printed materials Event, breakfast, lunch, all-day coffee break, cocktail dinner party.

3. Advertising Services

  1. In order to take advantage of advertising services, please include a notification in the on-line registration form https://freshmarket.eu/pl/fresh-market-b2b-meetings-trade-show-2023/rejestracja-fresh-market-2023/ or contact the Organiser directly: tel+48 603 811 818.
  2. Available forms of advertising services and the price list are sent in the form of an offer to the e-mail address of those interested.
  3. The choice of advertising space is related to the applications’ filing order.
  4. The advertiser undertakes to send graphic materials for publication in the catalog in accordance with the order made and with the technical requirements of the organizer by the date placed on the website https://freshmarket.eu/pl/fresh-market-b2b-meetings-trade-show-2023/dolacz-do-nas-i-poznaj-liderow-branzy/wazne-daty/ .In case of failure to provide a proof template, the Organizer will not consider complaints related to the color of printing.
  5. In the case of failure to meet the above requirements, the Organiser has the right to refuse to publish the advertisement.
  6. Advertisers agree to deliver leaflets, brochures and catalogues (to be used as the materials) no later than 10 days before the Event. The Organiser does not guarantee the distribution of advertising materials delivered after this deadline.
  7. Large format banners intended for installation on the Hotel Mazurkas premises shall meet technical requirements. In the case of failure to meet the above requirements, the Organiser has the right to refuse to install the banner on the premises. Responsibility for installation and disassembly of banners shall lie with the Hotel Mazurkas.
  8. If the Advertiser wishes to use a non-standard form of advertising that is not described by the Regulations, he/she shall discuss it with the Organiser.
  9. It shall be prohibited to spread leaflets, brochures and catalogues, and other items functioning as advertisements, throughout the Event facility without the consent of the Organiser.
  10. The Advertiser has the right to change the scope of the order included in the Fresh Market 2023 Advertising Services Form, provided that the change is submitted to the Organizer in writing no later than 15 days before the date of the commencement of the Event. In such case, the Organizer agrees to accept the change of order and pay the Advertiser the difference in price no later than 15 days after the date of the end of the Event. If the value of the new order is higher than the value of the previous order, the Advertiser undertakes to pay the difference in price within the period specified on the VAT invoice issued.
  11. If the cancellation of an order included in the Fresh Market 2023 Advertising Services Form is made less than 15 days before the start date of the Event, the Advertiser is obligated to pay the full amount specified in the Form.

4. Payments

  1. The Registrant is obliged to pay fees associated with participation in the Event according to the rates set by the Organiser. Fees shall be paid during the on-line registration, when the invoice is produced for the requested service.
  2. Bank transfer payment is possible, upon prior notice to the Organiser’s office. Payment shall be made within the period specified in the invoice. In payment matters, please contact the Organiser’s accounting office: tel+48 609 458 565.
  3. To benefit from discounts, the applicants shall register within the period of promotion determined by the Organiser (paragraph 2.6) and pay the invoice in accordance with the payment deadline.
  4. Any delay in payment under these Regulations shall give rise to the payment of interest at a rate equal to twice the rate of statutory interest.
  5. Making all payments specified by these Regulations shall be a condition for participation in the Event.

5. ​Security and Maintenance

  1. Responsibility for the overall security of the Event facility shall lie with the Hotel Mazurkas, which is authorized to take any control measures to ensure safety.
  2. The Organiser shall not insure and is not responsible for the damage, theft and loss of possessions and valuables belonging to the Participants, as well as for damages caused by the Participants and the force majeure.
  3. Responsibility for the security of the Participants in the hotel and within the Conference site shall lie with the security service employed by the hotel Mazurkas.
  4. Filming, recording and photographing without the consent of the Organiser shall be prohibited.
  5. Participants are financially liable for damage caused by themselves, both on the Event premises, and in the places of accommodation.

6. Cancellation of Participation

  1. The Participant shall have the right to withdraw from participation in the Event and to obtain reimbursement of 50% of the paid amount. In order to obtain reimbursement, the Participant shall submit written notification of withdrawal from participation in the Event to the Organiser’s office no later than 30 days before the Event. In the case of notifications received after this date, the Organiser shall not return the money.
  2. The Registrant has the right to change the Participants’ personal data which has been registered. For this purpose, the Registrant shall deliver the new personal data of Participants to the Organiser’s office no later than 7 days before the Event. Information submitted after this deadline might not be acknowledged by the Organiser.

7. Complaints

  1. Any claims by Participants to the Organiser shall be prepared in writing and sent by registered mail within 7 days from the date of the end of the Event. After the expiry of the above specified time, no claims will be considered.
  2. The participant’s complaints arising from the implementation of the agreement do not entitle the Participant to delay the transmission of claims, in whole or in part.
  3. Any claims against the Organiser of the Event by the Participants shall be submitted in writing by registered mail to the registered address of the Organiser.

8. Protection of Personal Data

1. In accordance with the European Parliament and Council Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), we inform you that the personal data you provide (hereafter User/Customer) in registration forms and newsletters on the Site, and in connection with registration for the annual Fresh Market conference and application to the Fresh Market Guide and Fresh Market Award, are used only for activities related to the operations of KJOW Sp. z o.o.

  1. The data entrusted to us are used exclusively for:

    enabling the use of Services; participation in the annual Fresh Market conference; participation in online meetings using the Fresh Market B2B Meetings application (also known as “Freshka”); participation in online meetings using external applications indicated by the Administrator; conclusion and execution of a sales contract or electronic service contract (e.g., account on the Site, access to the Fresh Market B2B Meetings application); informing about our offers and events; sending information and advertisements related to the fruit, vegetable, mushroom, and flower market.

  2. In the case of a Customer who uses the postal or courier delivery method, the Administrator provides the collected personal data of the Customer to the selected carrier or intermediary executing shipments on behalf of the Administrator.

  3. In the case of a Customer who uses electronic payment methods or a payment card in the Service, the Administrator provides the collected personal data of the Customer to the selected entity handling the above payments in the Service.

  4. In the case of a Customer who uses the online meeting service in the Service, the Administrator provides the collected personal data of the Customer to the selected entity handling online meetings. Only to the extent necessary to use the service (usually the email address).

  5. The Administrator may process the following personal data of users using the Service: first and last name; email address; contact phone number; delivery address (street, house number, apartment number, postal code, city, country), residence/business address/headquarters (if different from the delivery address). In the case of Service Recipients or Customers who are not consumers, the Administrator may also process the company name and tax identification number (NIP) of the Service Recipient or Customer.

  6. Providing personal data is voluntary, although not providing the personal data indicated on the Service page and in the Service Regulations necessary to conclude and execute the Sales Agreement or the Electronic Service Agreement results in the inability to conclude this agreement.

  7. The basis for processing personal data of the Service Recipient or Customer is the necessity to perform the contract to which he is a party or to take actions at his request before its conclusion. In the case of processing data for direct marketing of the Administrator’s own products or services, the basis for such processing is (1) the prior consent of the Service Recipient or Customer or (2) the fulfillment of legally justified purposes pursued by the Administrator (according to Art. 23 par. 4 of the Personal Data Protection Act, direct marketing of the Administrator’s own products or services is in particular considered a legally justified purpose).

  8. The personal data administrator is KJOW Sp. z o.o.

  9. At any time during the contract, you have the right to:

    withdraw your consent to the processing of personal data at any time, however, withdrawal of consent does not affect the legality of processing that was carried out on the basis of consent before its withdrawal; withdraw consent to the processing of data for the purpose of direct marketing of the Administrator’s own products or services; file a complaint with the supervisory authority, i.e. the General Data Protection Inspector; request from the personal data administrator access to your personal data, their correction, deletion or restriction of processing, and also from May 25, 2018 – the right to transfer data to another administrator; to exercise the rights mentioned above, you can contact the Administrator by sending an appropriate message in writing or by email to the Administrator’s address indicated on the Service page.

  10. Providing personal data is voluntary, but without providing them, you will not be able to use the services offered by the Service or participate in the Fresh Market conference and meetings.

  11. Personal data is processed by the organizer, KJOW Sp. z o.o., based on the consent given (from May 25, 2018 – on the basis of Art. 6 par. 1 lit a) of the Regulation of the European Parliament and of the Council (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, also known as the General Data Protection Regulation).

  12. The personal data provided will be stored for the period necessary to use the Services or participate in the Fresh Market conference, Fresh Market meetings, but no longer than until the possible withdrawal of consent to data processing, with the reservation of further processing allowed by law, including in the scope of resolving the validity of claims related to the processing of personal data by the Administrator (taking into account the limitation periods).

9. Final Provision

  1. All the Participants have the right to use Hotel Mazurkas parking spaces for free for the duration of the Event. After entering the car park, a parking card shall be collected at the entrance gate. Before leaving the car park, the card shall be punched at the hotel reception. Free parking shall apply from 5:00 a.m. on 20.09.2023 to 21:00 p.m. on 20.09.2023. In the case of cars left at the parking lot outside the hours specified in these Regulations, the owners shall be obliged to cover the parking costs.
  2. The Organiser shall not book hotel accommodation and will not incur its costs. The Participants can individually book Hotel Mazurkas rooms.
  3. The Participants shall cover the transport costs themselves.
  4. In the case of disturbing customary and accepted standards and serious breaches of the Regulations of the Event, the Organiser has the right to remove the Participant from the site of the Event, by law enforcement officers.
  5. The organiser reserves the right – in the event of circumstances beyond his control – to cancel, or postpone the Event. If the Event does not take place due to reasons beyond the Organiser and on which he had no influence, the Participant is not entitled to any compensation or refund of any fees associated with attending the Event. The exception is the cancellation of the meeting due to the introduction of Covid-19-related restrictions by the Polish government.
  6. The organizer reserves the right to use photos taken at the event in order to promote next editions.
  7. In any matters not regulated herein, the provisions of the Civil Code shall apply.
  8. Any disputes arising out of these Regulations shall be resolved by an appropriate court.
  9. These Regulations have been drawn up in two language versions. In case of any discrepancy between the Polish and English versions, the Polish version shall prevail.
  10. The Organizer has the exclusive right to interpret these Regulations.
