1. General provisions
- The Competition “FRESH MARKET AWARD – PRODUCT OF THE YEAR 2024 – hereinafter referred to as the “Competition”, is subject to the provisions of these Terms and Conditions and generally applicable laws.
- The Competition is conducted on the website www.fresh-market.pl and during “Fresh Market 2024” on 18th September 2024.
2. Organiser
- The Organiser of the Competition is KJOW, with its registered office at ul. Marii 17/25, 05-803 Pruszków, registered in the National Court Register under number KRS 0000321131, hereinafter referred to as the “Organiser”.
- The Organizer has the exclusive right to interpret these Regulations.
3. Purpose of the Competition
- The purpose of the Competition is to select products and innovations in the fruit, vegetable and flower industry that will find the greatest recognition from the readers of www.fresh-market.pl and the participants of the “Fresh Market 2024 B2B Meeting and Trade Show”. The results of the Competition will reflect only the voters’ preferences.
4. Duration of the Competition
- The Competition runs from the 1st of July 2024 to 18th September 2024.
5. Product entry
- Products for the “Fresh Market Award – Product of the Year 2024” Competition can only be submitted by Fresh Market participants. The product for the Competition must be submitted by 18.08.2024.
- A company may submit more than one product, but the fee is calculated on each product submitted.
- To submit a product for the Competition, the Company which submits the product must first complete the registration form confirming its participation in “Fresh Market 2024” and pay the relevant fees.
- In the event of cancellation of participation in the Competition, the product submitted to the Competition by the resigning participant loses the right to participate in the Competition, which does not exempt the applicant from the total participation fee for “Fresh Market Award 2024”.
- Products may be entered into the Competition by production companies, distribution companies and companies offering services to the fruit, vegetable and flower industry.
- Candidate products can be fruit and vegetables as new varieties or those known on the market but proposed in new iterations, packaging, technical equipment or services for the industry.
- The product submitted to the Competition must be present on the European market in the calendar year in question.
- All participants are solely responsible for taking steps to protect their innovations and intellectual property through patents, copyrights, registered names, trademarks or other intellectual property rights. The organizer is not responsible for possible copyright infringement by third parties resulting from the promotion of the submitted products on the organizer’s website.
- Companies submit products by completing the entry form available at www.freshmarket.eu
- The product must be submitted to the Competition between 1 June and 18 August.
- The submission form should include:
- the name of the product,
- the name of the company,
- a short description of the product (1800 characters including spaces),
- a link to a website where a more extensive description of the product can be found,
- one or more photos,
- a short justification as to why the product deserves the “Fresh Market Award – Product of the Year 2024”.
6. Product registration fee
- The registration of a product for the Competition is payable at a cost of EUR 390 for one product.
7. Promotional campaign
- The promotional campaign includes:
- Full information about the product and the company in Polish and English (up to 1800 characters), together with photographs and contact details, published on www.freshmarket.eu (Fresh Market Award candidates section)
- A banner promoting the award and the candidates displayed on www.fresh-market.pl.
- Information about candidate products and companies will be promoted on the Fresh Market 2024 website
- Printed information and images of each product and company in the “Fresh Market 2024” Folder
- Individual promotional stand during “Fresh Market 2024” where all candidate products will be displayed
- Newsletters sent to website users with information on candidate products
- Mailings sent regularly to editors of the trade press with information about the “Fresh Market Award 2024” and the candidate products, as well as the winner at the end of the Competition.
- 1/4 page advertisement in the Fresh Market Guide 2024/25 catalogue (publication January 2025) with a value of EUR 390 prepared by the applicant.
8. Nomination of a product for an award
- From the submitted products, the editorial board will select up to 10 products nominated for the “Fresh Market Award – Product of the Year 2024”. The nominated companies will hereinafter be referred to as the “Nominees.”
- Regardless of the care taken by the editors, the nominations will – necessarily – be subjective. No one can lay claim to the inclusion of products on the Nomination List or to the results of the Competition reflecting the preferences of voters.
- The Competition organizer reserves the right to use the submitted materials in publications, magazines and web portals.
- The organizer reserves the right not to award any Nominations if the submitted products do not meet the requirements of innovation and quality.
- The Organizer will inform participants of the nomination award in writing between 1 July and 31 August, depending on the date of receipt of the application.
- Nominees will be given the opportunity to present their product at the Fresh Market Award booth to all interested product participants at the “Fresh Market 2024”. Nominees are responsible for the condition of the product during the exhibition and its timely delivery and installation at the exhibition.
9. Rules of voting
- Votes for nominated products can be cast on the website www.fresh-market.pl from 1 July to 13 September 2024 and during Fresh Market on 18 September 2024. Votes cast on www.fresh-market.pl after the deadline of 13 September 2024 will be invalid.
- The list of nominated products will be published from 1 July 2024 on www.fresh-market.pl and www.freshmarket.eu
- A participant can cast only one vote. Casting a valid vote is understood to mean completing the voting form on www.freshmarket.eu or during “Fresh Market 2024” and selecting one product.
- The product that gains the highest rating in the voting on www.fresh-market.pl will receive the “Fresh-market.pl Readers’ Choice Award”. The product that wins the vote during the “Fresh Market 2024” Gala will receive the title of “Fresh Market Award – Product of the Year 2024” and a bronze statue of the Competition. Products that come in 2nd and 3rd place will receive engraved plaques.
- The counting of votes is supervised by a representative of the Organizer and 2 persons from among the non-nominated participants of the Fresh Market 2024 Gala.
- In the event of a tie of votes, the Organizer will decide the winner.
- All submitted products that do not win the Competition will receive a diploma with the inscription “Product commended in the Fresh Market Award 2024”.
10. Prizes
- The winners of the Competition will be honored with statuettes and diplomas at a Gala ceremony held during Fresh Market 2024. The Awards Gala begins at 5:00 pm and ends at 6:00 pm on September 18, 2024. The organizer requires a representative of the winning company to be present at the Gala to receive the Prize.
- The winner selected by the readers of the fresh-market.pl portal will receive the “Fresh Market Readers’ Award” and an advertising package in the Fresh Market portal/directories worth 1000 EUR. The winner selected by the participants of the “Fresh Market 2024” Gala will receive the title of “Fresh Market Award – Product of the Year 2024” and an advertising package in the Fresh Market portal/directories worth EUR 1500.
- Companies will be entitled to use the logo “Fresh Market Award – Product of the Year 2024” in their marketing materials and to use the title “Fresh Market Award – Product of the Year 2024” in relation to the winning product. In addition to the title of the award, the Organizer always requires the year of the award.
- The winning products will be described at www.fresh-market.pl and www.freshmarket.eu.
- All necessary information will be published on www.freshmarket.eu.
- Prizes will be drawn among the participants of the event who voted for the product.
- The prizes will only be drawn among those who have voted in accordance with these regulations, meaning that:
- have rated one product,
- have provided their address and phone number.
- The Organizer reserves the right to publish the results of the Competition and the list of awarded persons on the websites www.fresh-market.pl and www.freshmarket.eu.
11. Results of the Competition
- The results of the Competition will be announced at the “Fresh Market 2024” Gala and published on www.freshmarket.eu and www.fresh-market.pl
12. Final Provisions
- Entering the Competition is tantamount to acceptance of these Regulations.
- These Regulations are the only document defining the rules of conducting the action.
- The Organizer shall not be responsible for the inability to collect the prize for reasons attributable to the winner.
- The content of these regulations can be found on the organizer’s website: www.freshmarket.eu.
- The organizer will make every effort to safeguard the innovation or supporting documentation or materials to be judged and exhibited as long as they are in the organizers’ possession, but the organizer shall not be liable for damage, loss or other risks, except for malice and gross negligence.
- Complaints and correspondence concerning matters related to the Competition should be addressed to the Organisers at: KJOW, ul.Marii 17/25, 05-803 Pruszków.
- The complaint will be considered by the Organizer within 14 days of its receipt. Information about the consideration of the complaint will be sent by mail, to the address provided by the participant.
- The decision of the Competition Organizers on the complaint is binding and final.
- Prizes shall not be exchanged for their monetary equivalent.
- These Regulations have been drawn up in two language versions. In case of any discrepancy between the Polish and English versions, the Polish version shall prevail.
